There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

To start our argument, we will show that sporting governing bodies continuously insist that they are still on the other side of any kind of politics. Guided by Aristotle, who presented the reciprocity of ethics and politics, we will unveil the fallacy of this discourse. In a short genealogy of the relationship between sport, ethics, and politics, we will highlight (...) the Munich Olympics 1936 and Mexico Olympics 1968, where political engagement of sport was exposed clearly. At the same time, the supposed political neutrality of sport manifested an aristocratic preference for radical right regimes. After that, we will analyse the contemporary relation between sport, ethics, and politics in the light of recent developments, including sport’s ambiguous reaction on the Ukraine war. Further argument will be that sport’s in- and external politics, supported by sport ethics and the inherited mantra of the split between sport and politics, is more than just a hypocrisy. At the start, modern sport claims autonomy of governance to keep away from state domination, yet this very autonomy also freezes sport’s ethical core, forbidding athletes, coaches and others active in sport, to express any political engagement, other than passive acceptance of the regulation by governing sport bodies, as the only politics to be respected without deliberation. In the final part an alternative understanding of the dynamics between politics, the political and sport’s ethical core, will be presented to be included in the philosophy of sport and fully developed in following articles. _The power and materiality of form. On studying the forms of knowledge in catechisms and ship’s logs._ The article argues that in the emerging field of the history of knowledge, with its focus on the production, circulation and exchange of knowledge, explorations of _ forms _ will represent a valuable addition. Form is related to genre. Yet, while the identification of genres is largely based on linguistic, literary or rhetorical criteria, form is also about structures and materiality as well as (...) about practical and institutional preconditions. Form often attracts less attention than contents, although the form makes this content recognizable _ as _ knowledge. Our argument builds on the exploration of two different early modern knowledge forms, the catechism and the ship's log respectively. Both demonstrate how form is decisive in defining contents as authoritative knowledge. They also illustrate how form is a prerequisite to enable knowledge to circulate and be part of cultural exchange, and thus to be socially efficient. The forms serve to codify existing knowledge, but also to the production and circulation of new insights. When forms like the log and the catechism are examined historically, however, they can also be seen to live their own lives in a tension between stability and change. The forms themselves become objects of negotiations, change and innovation. (shrink)

Strong evidence shows that exposure and engagement with the natural world not only improve human wellbeing but can also help promote environmentally friendly behaviors. Human-nature relationships are at the heart of global agendas promoted by international organizations including the World Health Organization’s “One Health” and the United Nations “Ocean Decade.” These agendas demand collaborative multisector interdisciplinary efforts at local, national, and global levels. However, while global agendas highlight global goals for a sustainable world, developing science that directly addresses these agendas (...) from design through to delivery and outputs does not come without its challenges. In this article, we present the outcomes of international meetings between researchers, stakeholders, and policymakers from the United Kingdom and Brazil. We propose a model for interdisciplinary work under such global agendas, particularly the interface between One Health and the UN Ocean Decade and identify three priority research areas closely linked to each other: human-nature connection, conservation-human behavior, and implementation strategies. Lovers do not relate to their beloveds as seats of valuable qualities that would be replaceable for anyone with relevantly similar or more valuable qualities. Instead, lovers take their beloveds to be irreplaceable. This has been noted frequently in the current debate on love and different theories of love have offered different explanations for the phenomenon. In this paper, I develop a more complex picture of what is involved in lovers taking their beloveds to be irreplaceable. I argue that in (...) order to account for the beloved’s irreplaceability, a theory of love must meet two conditions: it must explain the subjective aspect as well as the moral aspect of the beloved’s irreplaceability. I show that current theories of love fail to meet these conditions, either one or both of them, and I offer an alternative account that does - an account according to which love is understood as a special kind of desire for the beloved as a person. The aim of this paper is twofold: first, to give a more nuanced picture of the beloved’s irreplaceability, acknowledging in particular that there is a moral aspect to the phenomenon that has not been attended to thus far; second, to introduce and motivate a new desire-based account of love. This is the first collection of essays devoted specifically to the nature and significance of Aristotle's anthropological philosophy, covering the full range of his ethical, metaphysical and biological works. The book is organised into four parts, two of which deal with the metaphysics and biology of human nature and two of which discuss the anthropological foundations and implications of Aristotle's ethico-political works. Argument of this text is that: to develop aesthetics of sport, we should not begin with aesthetics as philosophy of art but with aesthetics of everyday life; to start with aesthetics of sport, we should not begin with beautiful of ‘pure aesthetics’ but with the dramatic; to analyze the dramatic in sport, we should not open the analysis with analogy between theater and sport, but with sport as a sort of performance; to get at the meaning of sport as a (...) drama, we have to discuss different meanings ‘drama’ has in theory and everyday communication; to map the dramatic in sport as performance, we have to discuss some features of sport which determine its dramatics first, and its potential as spectacle later. To proceed with the argument, we have to take into account contemporary state of aesthetics, recent development of aesthetics of everyday life, and theory of performance, together with Bernard Suits’ definition of game, Gadamer’s idea of play, and Lévy-Strauss’ account on conjunctive and disjunctive ritual. At IAPS Ljubljana conference (September 2007) Dag Vidar Hanstad and Sigmund Loland presented a paper on elite-level athletes' duty to provide information on their whereabouts, to decide between two opposing positions: is this WADA demand justifiable anti-doping work or an indefensible surveillance regime? They concluded that on moral grounds this regime is conditionally acceptable, the condition being the acceptability of a general framework and objectives embodied in anti-doping global legislative foundations (the World Anti-Doping Code). But, as they said, principled objections (...) against the system have more universal relevance, which has to be taken seriously . To take this ambiguous and intriguing conclusion a step further, I propose a legal rather than ethical approach, from the aspect of constitutional and international human rights law, and the possible clash of two legally acknowledged values - the concept of elite sport without doping, and the concept of individual human rights. This conflict between ideological or moral values and the legality of individual rights is not a novelty. This paper presents three instances of this conflict: Bernard de Mandeville's differentiation between public and private values; Eug ne Sue's parallel legal and civil morals; and the contemporary moralisation of law which conflates legality into morality. The subordination of legality to morality has potentially dangerous consequences: here, Agamben's 'state of exception' comes to mind, with his analysis of potestas and auctoritas. However, in the case of sport and the war against doping, the origin of power is not in the nation state; it originates in civil society's non-governmental national and international bodies recognised as autonomous sources of legal order. Political philosophy is an examination of distribution of power in human communities and institutions. In previous period when identity issues were the most important political approach philosophy of sport had to deal mostly with discrimination and much less with the distribution of power in sport governance. Recent scandals revealed that at the top of sport governing bodies. Even more: it exposed the political character of the distribution of unleashed power in sport. That is why it is not enough to punish (...) ad to prevent. It is necessary to change the distribution of power, reform the models of control over political power in sport and to rethink the whole system of governance in sport. The proposal of this paper is just one short step in this direction with two points of departure: a change in initial sport’s associational character of aristocratic distribution of power into contemporary state of corporation with managerial distribution of power; and political philosophy’s proposals for models of democratic control at the global level. The aim of this paper is to defend the position that aesthetics and ethics in sport are not two separate domains or aspects. In sport, the aesthetic and the ethical both arise from sport’s attractiveness or from the pleasure sport offers to its activists and consumers. To think about sport philosophically, we should find a link and a principle beyond this division as a source of both the aesthetic and the ethical in sport. The philosophy and philosophical sociology of Jean-Marie (...) Guyau is presented as a response to this problem. Two points of fundamental importance are considered critically here: his criticism of any reductionism, and life or the idea of life as key principle of a philosophical system which puts ethics and aesthetics together. Naturalist aestetics, strictly speaking, is a move to establish naturalist explanation of aesthetic phenomena. It was nearly forgotten, at least in the history of aesthetics, where, if mentioned, it was put aside as something dead and despised. Its reappearance in recent years, among other occasions at the XIVIVth International Congress of Aesthetics (Rio de Janeiro, 2004), came as a surprise and a challenge. Its second modernity has predecessors in the first modernity, and Darwin is only one of the many, and (...) its background in contemporary naturalist proposals in social and human sciences (biosociology, evolutionary psychology, cognitive science, etc.). Contemporary proposals to explain some basic aesthetic preferences of taste, and aesthetic pleasure itself in terms of evolution, may be illuminated by historical background. We can also understand them (in Ulrich Beck's vocabulary) as second modernity, as a move to deal with uncertainties of aesthetics. What still makes contemporary naturalist aesthetics a continuation of aesthetic modernity, however, is its inability to take (contemporary) art seriously. (shrink)

Izkaže se, da modernistična zastavitev potiska v pozabo psihologistično estetiko in njeno obravnavo vzvišenega v francoski in angleški tradiciji. Pri Longinu ni najti modernistične strasti po spreminjanju razmer in izboljšanju človeštva. Pri Longinu nas vzvišeno s svojim učinkom ne pokliče v funkcijo subjekta napredka, ampak nam da čutiti, da smo poklicani v pozicijo opazovalca dovršenega naravnega teatra. Moralni (...) zakon, ki ga zbudi vzvišeno pri Longinu, je »conso-latio philosophiae«, medtem ko gre pri Kantu za »moralni entuziazem«. (shrink)

The present article intends to approach as its theme the encounter between the religions in the perspective of the hope in Jürgen Moltmann. In the first moment, it is noticed that, due to the serious problems that affect today’s society, there is the necessity of having a cooperation among the different religions, which will only be possible if there is a perspective of change based on hope in the transformation of the current reality Secondly, there is the discussion about the (...) need for a theology of hope that changes our thoughts and builds new perspectives from faith, and that strengthens the collaborative bonds of all those who seek the same ideal of building an alternative world, where justice and peace are its base. A third moment will be based on the following question: from the eschaton, what other world is it possible to build? As a thesis, Moltmann’s thought will be the reason to understand that in the eschaton what unites prevails over what divides, for the urgencies of transformation overcome divergences, being fundamental the perspective of hope as lens from which it is possible a collaborative encounter between religions. This article problematizes work practices with children, analyzing especially adult-centric practices and the ways in which they characterize public policies aimed at childhood in Brazil. Our study was based on the cartography method, which made it possible to monitor the uncertain psychosocial landscapes caused by the Covid-19 pandemic. It used methodological concepts from Institutional Analysis and the Sociology of Childhood, which intersected with elements of Afroperspectivist philosophy, such as represented among the Ibeji and the Erês. The methodological tool adopted was (...) the Conversation Circle, carried out online, which operated as a group apparatus characterized by welcoming and sharing, where it was possible to gather and analyze data on adult-centric practices among workers from different public agencies in health, social assistance and education, aimed at children in the state of Espírito Santo. Research diaries were also produced, which were referred to in the analytic process. The text identifies several aspects of Erean adult’s views of childhood, and offers insight into the knowledge and practices that contribute to the process of becoming-Erê, a possibility that can be exercised at any stage of life. A equipe da Enfermagem é privilegiada, pois, é o cuidador que permanece vinte e quatro horas na assistência direta do paciente, podendo ter uma visão ampliada da pessoa no processo do adoecimento, tendo a oportunidade de incorporar e desenvolver os princípios dos Cuidados Paliativos (CP). Na perspectiva holística da saúde a religião/religiosidade/espiritualidade é uma das possibilidades de cuidado e manejo, porém ainda muito negligenciada pelos profissionais da saúde, seja por desconhecimento ou preconceitos e tabus, mas que se torna essencial no (...) cuidado de pacientes em CP. Por meio deste relato de experiência, objetiva-se ressaltar a importância da religião/religiosidade/espiritualidade, no cuidado e manejo de pacientes em CP, a partir da experiência de uma profissional da enfermagem, sua prática em cuidados e docência, supervisionando alunos com pacientes em contexto dos CP. Anos acompanhando alunos na prática, demonstraram que os profissionais da enfermagem têm dificuldade de identificar o Sofrimento Espiritual (SE) dos pacientes, e quando identificavam, não sabiam o que fazer com esta demanda, delegando a outros profissionais da equipe, que também tinham dificuldades, causando um (des)cuidado na Dimensão Espiritual (DE) do paciente em CP, trazendo-o mais sofrimento e desconforto com sua finitude. Como resultado dessas reflexões, está sendo desenvolvida uma pesquisa de pós-doutorado, destinada a identificar a DE, construção de roteiro de educação permanente. Em síntese, esses profissionais tendo a capacitação para identificar o SE, explorar e cuidar da DE, poderão promover a proteção da saúde mental, tanto do paciente em CP quanto sua, e tornarem-se profissionais mais sensíveis na finitude. O texto propõe que as relações entre psicanálise e filosofia estão postas a partir do momento em que nova ciência concebida por Freud teve de tomar distância em relação aos saberes médicos nos quais, no entanto, ela se origina. Cabe dizer que, pela natureza mesma do objeto que ela delineia em seu horizonte de conhecimento, a psicanálise não apenas recorre, desde o seu ensejo, à filosofia, mas ganha necessariamente uma dimensão filosófica.

O artigo trata do tema hegeliano do reconhecimento (Anerkennung), que, graças aos cursos de Alexandre Kojève sobre a Fenomenologia do Espírito, ministrados na École des Hautes Études de 1933 a 1939, exerceu um forte impacto no pensamento francês do século XX. São explicitadas nele duas abordagens, uma otimista, a de Kojève, outra critico-construtiva, a de Jean-Paul Sartre.

Cada día es más evidente que existen muchas formas sutiles de exclusión y parcialidad que afectan el correcto funcionamiento de los sistemas jurídicos. El concepto de injusticia epistémica, introducido por la filósofa Miranda Fricker, ofrece una herramienta conceptual útil para comprender estas formas de exclusión y parcialidad judicial que a menudo pasan desapercibidas. En este artículo presentamos la teoría original de Fricker y algunas de las aplicaciones del concepto de injusticia epistémica en los procesos jurídicos. En particular, queremos demostrar que (...) la semilla sembrada por Fricker ha generado un floreciente campo de estudio en el cual el concepto se utiliza para analizar muchos fenómenos diferentes en el ámbito jurídico, no siempre siguiendo la caracterización original proporcionada por ella. Esto ha llevado a una distinción entre lo que llamaremos la versión estrecha del concepto, que se acerca a la descripción original de Fricker, y la versión más amplia de injusticia epistémica, que es una noción más controvertida porque existe el riesgo de que se confunda con otros conceptos más conocidos como el sexismo, la discriminación racial, la opresión, el silenciamiento y el gaslighting. Mostraremos que el valor de la versión estrecha es principalmente teórico y que para utilizar el concepto de injusticia epistémica se debe adoptar una comprensión más liberal del mismo. (shrink)

Language experience shapes the gradual maturation of speech production in both native and second languages. Structural aspects like the connectedness of spontaneous narratives reveal this maturation progress in L1 acquisition and, as it does not rely on semantics, it could also reveal structural pattern changes during L2 acquisition. The current study tested whether L2 lexical retrieval associated with vocabulary knowledge could impact the global connectedness of narratives during the initial stages of L2 acquisition. Specifically, the study evaluated the relationship between (...) graph structure and L2 learners’ oral production in the L2 and L1. Seventy-nine college-aged students who were native speakers of English and had received classroom instruction in either L2-Spanish or L2-Chinese participated in this study. Three tasks were used: semantic fluency, phonemic fluency and picture description. Measures were operationalized as the number of words per minute in the case of the semantic and phonemic fluency tasks. Graph analysis was carried out for the picture description task using the computational tool SpeechGraphs to calculate connectedness. Results revealed significant positive correlations between connectedness in the picture description task and measures of speech production in the phonemic and semantic fluency tasks. These correlations were only significant for the participants’ L2- Spanish and Chinese. Results indicate that producing low connectedness narratives in L2 may be a marker of the initial stages of L2 oral development. These findings are consistent with the pattern reported in the early stages of L1 literacy. Future studies should further explore the interactions between graph structure and second language production proficiency, including more advanced stages of L2 learning and considering the role of cognitive abilities in this process. Criado em 1969, o Festival Pan-africano de Cinema e Televisão de Ouagadougou, o Fespaco, é parte fundamental na história do cinema africano. Os elementos que compõem sua história têm servido a cineastas, curadores, pesquisadores e estudiosos da temática tanto como um termômetro de tendências cinematográficas quanto de direcionamento das políticas de cultura presentes dos caminhos do cinema continente. Mais ainda, sua história se conecta diretamente com os acontecimentos e debates no âmbito das políticas do continente. O presente artigo apresenta alguns (...) dos elementos que entrelaçam o desenvolvimento do cinema africano à história do Fespaco, no intuito de montar não só um panorama histórico do Festival mas também fornecer meios para a compreensão do cenário de desenvolvimento da produção de filmes na África. O presente trabalho tem o objetivo de compreender como o pensador francês Michel Foucault expande argumentativamente sua prática metodológica, à medida que acresce uns aos outros, e ao passo em que os descobre, métodos para pesquisas históricas. Tencionando alcançar tal intento, efetua-se estudo acerca: do modo como seus métodos se estruturam no bojo; dos objetos de estudo para os quais esses métodos se voltam ; das conclusões a que chega o autor em suas pesquisas históricas, sob a mediação dos métodos (...) utilizados. Com a explicitação destes eixos, demonstra-se que arqueologia do saber e genealogia do poder não são estritamente operações de pesquisas, organizadas em material impresso sob forma de livros. Tratam-se também, sobretudo, de instrumentos os quais contém finalidade política bem definida, qual seja: a de denunciar ou mesmo expor enquanto político clamor o caráter arbitrário que se esconde por detrás dos discursos científicos legitimados, demonstrando que o que conduz a tal legitimação é a supressão imanente, a sujeição, de distintos discursos – operação que se decorre através das relações de saber/poder as quais permeiam instituições, bem como se estendem em alcance à estrutura interna do espaço social na sua totalidade. In my previous texts on aesthetics of sport and of football, the accent was on dramatic aesthetic properties and on everyday aesthetics as a proper framework for the aesthetics of sport in general and football in particular. Here, following this starting point, the character of football as a game of social interactions and its character of purposive sport are examined, to find out what could be the most important aesthetic condition for playing the game and being-in-the-game. To get at the (...) core of the aesthetic side of football, the concept of aesthetic imagination is introduced as a necessary condition for playing the game of football, and three aesthetic regimes for creation of possible worlds or symbolic forms such as football are discussed. O contexto informativo está ameaçado pela ampla difusão e acesso de fake news – conteúdos falsos, que utilizam de características de notícias provenientes do jornalismo, para que os indivíduos que as recebam, acreditem que possuem cunho verídico, levando o leitor ao erro, devido sua má intencionalidade. Diante disso surge a questão: em que medida poderia uma fake news ser considerada informativa? Expõe-se neste artigo, planos da informação, que concentram algumas das principais teorias da informação. O artigo realizou uma pesquisa descritiva (...) com abordagem qualitativa. O levantamento bibliográfico teve como foco os temas fake news e a teoria da informação e ocorreu na Scientific Electronic Library Online – SciELO, em artigos de revistas disponíveis em acesso aberto. Ressalta-se que a discussão sobre o potencial informativo das fake news ainda é controversa e deve ser continuada por pesquisadores da Ciência da Informação, dada a relevância do tema para a sociedade em termos sociais, políticos e econômicos. Erigir o aumento da riqueza e da abundância como um objetivo primordial para a vita activa já se desenhava como premissa axiomática da economia política clássica, além do sonho idealizado dos pobres e despossuídos. Havia, no entanto, certa esperança utópica de que, ao viver em uma sociedade com maior abastança, as pessoas cidadãs buscariam mais plenamente o desenvolvimento de apropriada abstenção consciente do trabalho e do consumo em seu tempo livre, ou seja: que isento da dor e do esforço de (...) trabalhar e consumir, o animal laborans tornar-se-ia produtivo para si próprio, nutrindo-se de atividades “superiores”. No entanto, de quanto mais horas vagas dispõe o laborans, maiores são seus apetites de consumo e, sobretudo, uma sociedade abundante expõe devidamente a falácia do raciocínio anterior, uma vez que tudo pode ser reificado e comercializado. Esse artigo pretende analisar o fenômeno da sociedade de consumo contemporânea como engrenagem do ciclo vital, descrevendo de que modo, presas em seus próprios processos de trabalho e consumo, as pessoas cidadãs desfrutam apenas de uma política instrumental. Martin Strel, a Slovenian hero, swam all 3004 km of Danube in 200, and Mississippi in 2002, to become one of nominees for the sportsperson of the year award. Surprisingly, an orchestrated attack on his status as a sportsperson and on status of his achievements as sport records followed successfully. Martin did not get the award. He continued with his activities, swimming Parana, Jang Tse, and Amazonas lately, but was never mentioned in sport context again. This case is examined to (...) show how definition struggles serve to strengthen the border control between sport as such, and its internationally institutionalised realm. To make a comparison, the case of art and its definition is mentioned. Martin Strel did not endanger sport, being a false pretender on sport-status, but he endangered sport management and sport business. He was thrown out of the ?sport city?, to swim ?extra portes? and to inhabit a place where sport as ?esportes? originally belonges. (shrink)
